Terms of Service

This English version is provided for convenience. In case of any discrepancy, the Spanish version prevails.

Description of the service

Industric is an operations platform for make-to-order manufacturing companies, including modules for planning and APS, BOM and engineering, shop floor (MES), quality and 8D, purchasing and inventory, document management, customer portal and artificial intelligence with the Gilby AI assistant. We reserve the right to modify, add or remove features of the Service, giving reasonable advance notice of relevant changes.

Accounts and access

You are responsible for keeping your access credentials confidential and for all activity under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend accounts that breach these Terms.

Acceptable use

You agree not to:

• Use the Service for illegal or unauthorized activities.
• Attempt to access other customers' data without authorization.
• Reverse engineer, decompile or attempt to extract the platform's source code.
• Deliberately overload the Service's infrastructure.

Customer data

You retain ownership of all data you enter into the platform (“Customer Data”). You grant us a limited license to process that data solely to provide the Service. See our Privacy Policy for more details on data processing.

Plans and payments

The Starter (USD 69 per month), Pro (USD 199 per month, with 25 users included and USD 8 per month for each additional user) and Enterprise (from USD 499 per month, per contract) plans are billed annually, in US dollars. Current prices are published on the Pricing page. Operators with PIN access to the shop floor and customers using the portal do not count as users. The Free plan has no cost, requires no contract and access is granted on request. Overdue payments may result in temporary suspension of access to the Service, after notice.

Intellectual property

All rights to the platform, its code, design and brand are the exclusive property of Industric. These Terms do not grant you any intellectual property rights in the Service beyond the right of use described here.

Availability and support

We work to keep the Service highly available, subject to scheduled maintenance and circumstances beyond our reasonable control. Support levels and response times vary according to the contracted plan.

Limitation of liability

To the extent permitted by applicable law, Industric will not be liable for indirect, incidental or consequential damages arising from use of the Service. Our total aggregate liability will not exceed the amount paid by the customer in the twelve months before the claim.

Termination

Either party may terminate the service agreement in accordance with the terms of the current commercial contract. Upon termination, we will make the Customer Data available to the customer for a reasonable period for export.

Changes to these Terms

We may update these Terms from time to time. We will notify material changes by email or through a notice on the platform. Continued use of the Service after such changes constitutes acceptance of the new Terms.

Governing law

These Terms are governed by the laws of the Republic of Colombia, without prejudice to any mandatory provisions that may apply in the customer's jurisdiction.
